PRIVACY AND COOKIES POLICY
SIA BAFO undertakes to ensure the protection of your personal data and privacy in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), this Privacy Policy and other requirements of the laws and regulations in force in the Republic of Latvia in the field of processing of personal data and privacy.
With this Privacy Policy, SIA BAFO provides you information regarding the principles, methods, purposes, extent, conditions and terms of its processing of personal data, as well as on your rights with regard to the processing of personal data by us.
1. Personal data controller and processor
1.1 SIA BAFO, Reg. No. 40003823816, legal address: Audēju street 14-3, Riga, Latvia, LV-1010, is the personal data controller.
1.2 Personal data processors are persons who, on behalf of SIA BAFO and in accordance with its instructions, process personal data and have undertaken to observe the requirements of regulatory enactments on data processing.
2. Customers’ personal data categories undergoing processing and data types
2.1. Customers’ personal data categories processed by SIA BAFO differ depending on which service of SIA BAFO the customer wants to use. Customers’ personal data processed by SIA BAFO can be categorised as follows:
2.1.1 For execution of a purchase made via the SIA BAFO e-store (www.thepowerofrowing.com) and subsequent delivery of the goods, SIA BAFO may process the following customers’ personal data, depending on the type of delivery of the goods chosen by the customer: email address, name, surname; address, mobile phone number.
2.1.2 Customers’ personal data processing for distribution of SIA BAFO news via email, and, according to the extent and purpose of the information provided by the customer, SIA BAFO may process the following customer’s personal data: email address, phone number.
3. Purposes of processing of personal data
3.1 SIA BAFO shall only process the obtained customers’ personal data for the purposes set out below, while observing the requirements of the laws governing the processing of personal data and depending on the amount of personal data provided by the customer and subject to consent to the specific processing purposes.
3.2 SIA BAFO shall process the obtained customers’ personal data for the following specific purposes:
3.2.1 address: for delivery of goods purchased via the SIA BAFO e-store, if, for the type of delivery chosen by the customer, it is necessary to indicate the address at which the goods are to be delivered to the customer;
3.2.2 mobile phone number: for arranging orders of the goods placed via the SIA BAFO e-store and for receipt of information by the customer on the place and time of delivery of the goods ordered via the SIA BAFO e-store;
3.2.3 email address: for sending notices necessary to provide information about orders placed via the SIA BAFO e-store and payment and delivery information to the customer, and/or for sending news in electronic format.
4. Basis and term of the processing of personal data
4.1 Personal data processing by SIA BAFO may only be carried out based on one of the following:
4.1.1 Customer consent: a personal, freely given, specific and informed indication by the customer to the effect that he/she consents to the processing of his/her personal data. By providing personally his/her personal data, the customer confirms his/her consent to the processing of his/her personal data.
4.1.2 Fulfilment of a legal (statutory) obligation: if it arises from laws or administrative acts or lawful requests issued by public authorities, SIA BAFO shall be entitled to process the data received from the customer to the extent necessary to fulfil the requirements of the respective law or administrative act or to respond to official and lawful requests by public authorities.
4.1.3 Observance of legitimate interests: SIA BAFO shall be entitled to process customers’ personal data in order to ensure the observance and protection of its legitimate interests.
4.1.4 SIA BAFO shall only process the personal data provided by the customer for so long as the customer’s consent to the processing of the data is valid or for as long as it is necessary to protect its legitimate interests or fulfil its legal obligations and until the purpose of the processing of the personal data is achieved.
5. Recipients of personal data
5.1 When processing customers’ personal data, SIA BAFO” shall maintain strict confidentiality and ensure protection against potential unauthorised access by third parties to said personal data, and against unintentional loss or destruction of such personal data. Subject to the existence of valid legal grounds, SIA BAFO, by way of exception, may also transfer customers’ personal data to the following:
5.1.1 public administration authorities, law enforcement authorities - upon a lawful request therefrom;
5.1.2 persons who provide services to SIA BAFO, e.g. service providers who deliver the ordered goods to the customers.
6. Cookies Policy of SIA BAFO:
6.1 The web page of SIA BAFO uses cookies which store information on the activities performed by a user of the web page, e.g. the user’s IP address, domain name, browser and type of the operating system used, the duration of their visit to the web page and information searched for on the web page. The data stored by cookies are anonymised.
6.2 The information collected by using cookies is sent to Google to prepare statistical reports on the e-store. SIA BAFO uses Google Analytics, which helps analyse how visitors use the web page.
6.3 Cookies are very small text files which are created automatically during a web page visit and are stored on the user’s computer, tablet or smart phone (device), thereby allowing for the customisation of the usability of the web page for each respective user thereof. Cookies are stored on the user’s computer to the extent chosen by the user, which can be set in the settings of the computer’s browser.
6.4 “Session cookies” are temporary files which are stored on the user’s computer, tablet or smart phone until the user terminates their visit to the web page.
6.5 “Permanent cookies” are files which are stored automatically on the user’s computer, tablet or smart phone during the visit and remain on the device until the user deletes them or, depending on the browser settings, they are deleted automatically.
6.6 How to block the use of cookies: when visiting the e-store, customers see a notice on the use of cookies on the SIA BAFO website. By clicking on “AGREE” or continuing to use the web page www.thepowerofrowing.com, the customer confirms that he/she agrees to the use of cookies when visiting the SIA BAFO e-store. At the same time, any customer has, in principle, the option to control and block the use of cookies on his/her device and the respective browser, as well as to delete the stored cookies at any time by using the settings of his/her browser for this purpose. Please note that the respective settings and/or changes to settings should be made for each device and browser individually.
6.7 Changes to the Cookies Policy: SIA BAFO informs that it may make changes to the Cookies Policy at any time and at its sole discretion. Any changes shall be valid from their publication on the e-store. SIA BAFO invites you to review this document periodically so that you stay informed of the latest changes.
6.8 SIA BAFO only uses cookies on the basis of explicit consent provided by visitors to the e-store for the use of cookies. This provision shall not apply to those cookies which are necessary for the smooth operation of the web page of SIA BAFO but which do not store information on the user’s activities on the e-store for a prolonged period of time.
7. Customer’s rights as regards the processing of personal data by SIA BAFO
7.1 The customer shall have the right to choose what data to provide SIA BAFO and to what extent it may be processed, and may withdraw his/her consent for the processing of his/her personal data in full or in part by asking SIA BAFO to stop the processing of all or any of the customer’s data. Withdrawal of consent shall not affect the legality of the processing of the customer’s personal data carried out until the withdrawal.
7.2 If the customer chooses not to provide personal data or any part thereof or to withdraw his/her consent in full or in part (as regards certain provided data), SIA BAFO will not be able to provide services to the customer for the provision of which the personal data are needed.
7.3 Considering that it is necessary for SIA BAFO to unambiguously identify a customer who withdraws, in full or in part, his/her consent to the processing of personal data, the customer may send a consent withdrawal notice to SIA BAFO in the following ways:
7.3.1 By sending a consent withdrawal notice to SIA BAFO via email to: [email protected] from the email address that was indicated by the customer when making the purchase via the SIA BAFO e-store. In this case, the customer should indicate in the consent withdrawal notice his/her name, surname, as well as the extent to which the consent is withdrawn;
7.3.2 By sending the consent withdrawal notice by post to the SIA BAFO registered office: Audēju street 14-3, Riga, Latvia, LV-1010, specifying the customer’s name, surname, as well as the extent to which the consent is withdrawn. The consent withdrawal notice should include a handwritten signature.
7.4 The customer shall be entitled at any time to object to the processing of his/her personal data by SIA BAFO, as well as to request that SIA BAFO perform certain activities as regards the customer’s personal data, by sending a request to SIA BAFO” by any of the means specified in Clauses 7.3.1 and 7.3.2. The customer shall be entitled to request that SIA BAFO:
7.4.1 issue personal data held by SIA BAFO about the customer;
7.4.2 to rectify, delete or supplement the personal data in accordance with the customer’s instructions, providing justification of such request;
7.4.3 restrict (temporarily stop) the processing of certain or all types of the customer’s personal data;
7.5 The customer shall be entitled to obtain from SIA BAFO information on the transfer of his/her personal data to third parties and on the persons (natural or legal) and/or public authorities to whom SIA BAFO” has provided any information regarding the personal data of the customer, except in cases where such information has been provided on the basis of a request by a body performing operational activities or another competent authority within the framework of criminal proceedings, or in other cases where the law prevents direct disclosure of the respective information.
7.6 In the event of disagreement in connection with the processing of personal data by SIA BAFO, the customer shall be entitled to submit a complaint to the complaints authority, the Data State Inspectorate.
8. Changes to the Privacy Policy
8.1 SIA BAFO may make changes to the Privacy Policy any time and at its sole discretion if such changes conform to the requirements of personal data protection law. Any changes shall be valid from their publication on www.thepowerofrowing.com. Your obligation is to review this Privacy Policy periodically to stay informed of any changes.
